How we get the personal information and why we have it
Most of the personal information we process is provided to us directly by you for one of the following reasons:· Enquiring about our services. · Messages via Social media platforms, like Facebook. We also receive personal information indirectly, from the following sources in the following scenarios:· Through ethical referrals from other professionals or agencies. · GP surgeries · Telephone/email enquiries. We use the information that you have given us in order to discuss potentially working together. Under the UK General Data Protection Regulation (UK GDPR), the lawful bases we rely on for processing this information are:
(a) Your consent. You are able to remove your consent at any time. You can do this by contacting DH Counselling, 07466 066736 or emailing [email protected]
(b) We have a contractual obligation.
(c) We have a legal obligation.
(d) We have a vital interest.
(e) We have a legitimate interest.
How we store your personal information
When you contact me with an enquiry about my counselling services I will collect information to help me satisfy your enquiry. This will include Name, Telephone number, email address and message. Alternatively, your GP or other health professional may send me your details when making a referral or a parent or trusted individual may give me your details when making an enquiry on your behalf. If you decide not to proceed I will ensure all your personal data is deleted within 72 hours. If you would like me to delete this information sooner, just let me know.
While you are accessing counselling.
Rest assured that everything you discuss with me is confidential. That confidentiality will only be broken if there is a threat of harm to you ‘the client’, another member of society or crime (I.e but not limited to money laundering, terrorism, court order, child or vulnerable adult). I will always try to speak to you about this first, unless there are safeguarding issues that prevent this.I will keep a record of your personal details to help the counselling services run smoothly. These details are kept securely on an encrypted storage device and are not shared with any third party. I will keep written notes of each session, these are kept in a locked storage cabinet. For security reasons I do not retain text messages for more than 24 hours. If there is relevant information contained in a text message I will retain it within the encrypted storage device to maintain an accurate client record for clinical purposes. Likewise, any email correspondence will be deleted after 72 hours if it is not important. If necessary I will retain it within the encrypted storage device to maintain an accurate client record for clinical purposes.
Once counselling has ended your records will be kept for 7 years from the end of our contact with each other and are then securely destroyed. If you want me to delete your information sooner than this, please tell me. Audits will be conducted to ensure no information is kept longer than it’s legal purpose as established under GDPR.
Your data protection rights
Under data protection law, you have rights including:
Your right of access - You have the right to ask us for copies of your personal information.
Your right to rectification - You have the right to ask us to rectify personal information you think is inaccurate. You also have the right to ask us to complete information you think is incomplete.
Your right to erasure - You have the right to ask us to erase your personal information in certain circumstances.
Your right to restriction of processing - You have the right to ask us to restrict the processing of your personal information in certain circumstances.
Your right to object to processing - You have the the right to object to the processing of your personal information in certain circumstances.
Your right to data portability - You have the right to ask that we transfer the personal information you gave us to another organisation, or to you, in certain circumstances. You are not required to pay any charge for exercising your rights. If you make a request, we have one month to respond to you. Visitors to my website When someone visits my website, I use a third party service, Google Analytic to collect standard internet log information and details of visitor behaviour patterns. I do this to find out things such as the number of visitors to the various parts of the site. This information is only processed in a way that does not identify anyone. I do not make, and do not allow Google to make, any attempt to find out the identities of those visiting my website. I use legitimate interests as my lawful basis for holding and using your personal information in this way when you visit my website. No user-specific data is collected by me or any third party. If you fill in a form on my website, that data will be temporarily stored on the web host before being sent to me.
